Hughell, Jr. whose last known place of residence is unknown, each of you will take notice that on September 23, 2025, Plaintiff, filed an Amended Complaint for foreclosure in the Lake County Court of Common Pleas, being Case No. 25 CF 000332 alleging that there is due to the Plaintiff the principal amount of $90,581.90, together with interest at the rate of 5.060% from December 7, 2024, other fees in the amount of $7,084.70, and court costs, applicable to the terms of the Promissory Note secured by a Mortgage on the real property, which has a street address of 940 Midway Boulevard, Painesville, OH 44077. A full description can be obtained from the Lake County Auditor at 105 Main St, Painesville, OH 44077. Plaintiff further alleges that by reason of a default in said Promissory Note, the conditions of said Note and Mortgage have been broken and the same has become absolute. Plaintiff further alleges that the current Deed of record from Evelyn E. Soke to Evelyn E. Soke and Georgia D. Horton recorded April 24, 2012 in Instrument No. 2012R010886, Lake County, Ohio records, is missing the legal description for Parcel No. 11-B-043-C-00-063-0 due to a scrivener’s error and mutual mistake of fact between the parties, and that Plaintiff is entitled to a judgment reforming the Deed to incorporate the missing legal description. Plaintiff further alleges that the Mortgage from Evelyn E. Soke and Georgia D. Horton to Plaintiff recorded April 24, 2012 in Instrument 2012R010887, Lake County, Ohio records, is missing the legal description for Parcel No. 11-B-043-C-00-063-0 due to a scrivener’s error and mutual mistake of fact between the parties, and that Plaintiff is entitled to a judgment reforming the Mortgage to incorporate the missing legal description. Plaintiff prays that the Defendants named above be required to answer and assert any interest in said real property or be forever barred from asserting any interest therein, for foreclosure of said mortgage, marshalling of liens, and the sale of said real property, and that the proceeds of said sale be applied according to law. Said Defendants are required to file an Answer on or before 28 days after the last week that the publication has run for THREE successive weeks, or judgment may be rendered as prayed for therein.
