Legal Notice • Public Notice NOTICE OF RECEIPT OF MODIFICATION REQUEST FOR A 401 WATER QUALITY CERTIFICATION Public notice is hereby given that the Ohio Environmental Protection Agency (Ohio EPA) Division of Surface Water (DSW) has received a modification request for a 401 Water Quality Certification for a project to construct a gas station, convenience store and car wash. The modification, if approved, would result in an additional 0.46 acre of impact to wetlands. The modification request was submitted by Heisley Hendrix Properties, LLC. The project is located along Heisley Road, at the northwest corner of Hendricks Road, Mentor, Lake County, Ohio. The Ohio EPA ID Number for this project is 206692A. The certification modification request proposes a discharge of fill material into wetlands which drain to Heisley Creek which triggers Ohio’s antidegradation requirements. The antidegradation review requires applicants to justify the necessity of the proposed discharge and requires that any approved discharge be protective of Ohio’s water quality standards. Ohio EPA will review the modification request, and decide whether to grant or deny the certification, in accordance with OAC Chapters 3745-1 and 3745-32. No exclusions or waivers, as outlined by OAC rule 3745-1-05, apply or may be granted.
